1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Ayvik Global (OPC) Pvt. Ltd., the operator of Om Puja Arpan ("we," "us," or "our"), governing your access to and use of the Arpan mobile application and related services (collectively, the "Service").

By creating an account, placing a booking, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy, which is incorporated herein by reference. You must be at least 18 years of age to use the Service.

Om Puja Arpan is a technology platform that enables users to book end-to-end puja arrangement and conducting services. The Service facilitates:

• Selection and booking of puja ceremonies through the Arpan mobile application
• Procurement of puja samagri (ritual materials) appropriate for the selected ceremony
• Arrangement of decoration and setup at the user's chosen venue
• Coordination and assignment of a qualified Pandit to perform the ceremony at the user's location
• In-app payment processing via Razorpay

We reserve the right to modify, expand, suspend, or discontinue any aspect of the Service at any time without prior notice.

4. User Obligations

By using the Service, you agree to:

• Provide accurate, complete, and current information at the time of registration and booking, including your name, phone number, and the correct venue address.
• Use the Service only for lawful purposes and in accordance with these Terms and all applicable Indian laws.
• Ensure that the venue address provided is accessible to our Pandit, vendors, and setup team at the agreed date and time, and that entry is permitted and safe.
• Be present at the venue or have an authorised representative present to receive the service at the booked time.
• Not use the Service to cause offence, harass, or harm any Pandit, vendor, or member of our team.
• Not attempt to solicit or directly engage a Pandit or vendor introduced through Arpan for direct bookings outside the platform.
• Pay all applicable fees at the time of booking as specified in the app.

5. Booking, Pricing & Payment

All bookings are subject to availability of Pandits in your area. A booking is confirmed only upon receipt of full payment through the in-app payment gateway (Razorpay). You will receive a booking confirmation via the app and/or SMS.

• Prices for each puja package are as displayed in the app at the time of booking. We reserve the right to update pricing at any time; price changes do not affect confirmed bookings.
• All prices are in Indian Rupees (INR) and include applicable taxes unless otherwise stated.
• Payment is processed exclusively by Razorpay. Om Puja Arpan does not store your full card or banking credentials.
• All payments are final and non-refundable. Please review our Refund & Cancellation Policy before booking.

6. Role of Pandits and Vendors

Pandits and samagri/decoration vendors coordinated throughOm Puja Arpan are independent service providers. They are not employees, agents, or partners of Ayvik Global (OPC) Pvt. Ltd..

Om Puja Arpan acts as a booking and coordination platform. We are responsible for:

• Vetting and onboarding qualified Pandits
• Coordinating samagri procurement and decoration setup
• Communicating booking details to the assigned service provider
• Facilitating payment and issuing receipts

We are not responsible for the personal conduct, ritual interpretations, or individual beliefs of assigned Pandits beyond what is agreed in the booking. Any dispute arising from the conduct of an individual Pandit or vendor should be reported to us at support@ayvik.ai and we will investigate and take appropriate action.

7. Cancellation

Cancellations are governed exclusively by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. In summary: all payments are final; only rescheduling (not cancellation for a refund) is permitted, and only when requested at least 24 hours before the scheduled puja time.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Ayvik Global (OPC) Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.
• We shall not be liable for the acts, omissions, or conduct of any Pandit or vendor, including but not limited to delays, errors in ritual performance, or property damage at your venue caused by a service provider.
• Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid for the specific booking giving rise to the claim.
• We shall not be liable for failure to deliver the service due to force majeure events — including natural disasters, government orders, severe weather, strikes, or other circumstances beyond our reasonable control.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Indian law.

9. Intellectual Property

All content, trademarks, logos, user interface designs, and intellectual property within the Arpan application and associated materials are owned by or licensed to Ayvik Global (OPC) Pvt. Ltd.. You are granted a limited, non-exclusive, non-transferable licence to use the app solely for the purpose of accessing and using the Service.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of the Service without our prior written consent.

10. Prohibited Conduct

You must not:

• Use the Service for any unlawful, fraudulent, or malicious purpose
• Submit false, misleading, or fabricated information during registration or booking
• Attempt to circumvent, disable, or interfere with the security or proper functioning of the app
• Harass, threaten, or abuse any Pandit, vendor, or member of our staff
• Use the app to infringe the intellectual property rights of any third party
• Attempt to access accounts, systems, or data you are not authorised to access
• Use automated scripts, bots, or crawlers to access or scrape the Service

Violation of these prohibitions may result in immediate suspension or termination of your account and may be reported to law enforcement authorities.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which details how we collect, use, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023, and the IT Act, 2000.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted within the Arpan app with a revised "Last updated" date. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the Service.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms or the Service shall be resolved as follows:

1. Mutual discussion — the parties shall first attempt to resolve the dispute through good-faith negotiation.
2. Mediation — if negotiation fails within 30 days, the parties may seek mediation in Navi Mumbai, Maharashtra.
3. Courts — if mediation fails or is declined, disputes shall be subject to the exclusive jurisdiction of the competent courts of Maharashtra, India.

Nothing in this clause prevents either party from seeking emergency injunctive relief in an appropriate court.

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remainder of the Terms, which shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Ayvik Global (OPC) Pvt. Ltd.with respect to the Service and supersede all prior understandings, agreements, representations, or warranties.
